Image License Agreement

All images available for purchase on Jason Dirks Photography have a standard royalty-free license agreement with the following terms.

Standard Royalty-Free Image License Agreement

With purchase, you are hereby granted a perpetual, non-exclusive, non-transferable worldwide license to use the image for the permitted uses defined below.  If the image activity or use is not one of the permitted uses below or if the image activity or use is one of the prohibited uses below, then you are not allowed to use it. 

All other rights for this image, including, without limitation, all copyright and other intellectual property rights relating to the image, are retained by Jason Dirks Photography.

Permitted Uses:

1. Advertising and Promotional Uses: Printed materials, product packaging, presentations, catalogs, brochures, promotional greeting cards and promotional postcards (not for resale).
2. Entertainment Uses: Books and book covers, magazines, newspapers, editorials, and newsletters.
3. Online Publications: Web pages and blogs.
4. All other uses approved in writing by Jason Dirks Photography.

Prohibited Uses:

1. Design Templates Intended for Resale (Online or Offline): Image cannot be used on website templates, business card templates, electronic greeting card templates, and brochure design templates.
2. Products for Resale: Image cannot be included in postcards, mugs, t-shirts, posters and other items intended for resale.
3. Trademark and Logo: Image cannot be used as part of a trademark, trade name, business name, or logo.
4. Electronic Distribution: Image cannot be resold, shared, transferred or distributed to a third party as a mobile or electronic file or placed on a network server or web server for use by other users.
5. Offensive Use: Image cannot be used if considered by Jason Dirks Photography to be pornographic, obscene, immoral, infringing, defamatory or libelous in nature, or is reasonably offensive or unflattering to any person.
6. Source Code: Image source code cannot be used to reverse engineer or disassemble any part of the image.
7. Remove any notice of copyright, trademark or other proprietary right from any place where it is on or embedded in the image.

Terms of Agreement

This Agreement is effective until it is terminated. You can terminate this Agreement by destroying or deleting the image and any permitted copies or derivative images.  This Agreement also terminates without notice from Jason Dirks Photography if at any time you fail to comply with any of our terms. Upon termination, you must immediately stop using the image and destroy or delete all copies and derivative images.

NOTE: These terms above do not apply to the images available on Jason Dirks Photography for free download, without purchase.  Those images are licensed separately under the Creative Commons - Attribution-ShareAlike 2.0 Generic which means you are free to download, copy, distribute, transmit and adapt the image as long as you credit 'Jason Dirks' and link back to the original image.
